Conditions for Clients
1. Who we are and what Handnitas is
Handnitas is a technology intermediation platform that connects people who need services for their home (“Clients”) with independent professionals who provide those services (“Professionals”).
Handnitas does not provide repair, maintenance, cleaning, renovation or any other home service. It does not employ, subcontract, direct or supervise Professionals. It takes no part in carrying out the work and does not set its price, its timescale or the way it is performed.
Any contract arising from a job is entered into exclusively between the Client and the Professional. Handnitas is not a party to that contract.
2. Acceptance of these terms
Using the app means you accept these terms. To register you must be over 18 and have legal capacity to contract.
3. Price of the service
Handnitas is currently free for Clients. There is no charge for registering, posting requests, receiving quotes or accepting them.
Handnitas reserves the right to introduce paid services or subscription plans in the future. Any paid service will be communicated clearly and in advance, and no charge will be made for services previously provided free of charge without prior notice.
4. Payment for jobs
Handnitas does not manage, process, hold or intermediate in payment for jobs. The agreed price is paid directly by the Client to the Professional, by whatever means they agree, outside the platform.
Accordingly, Handnitas cannot hold funds, offers no money-back guarantee, does not act as an escrow agent and does not intervene in financial disputes between the parties.
5. How it works
- The Client posts a request describing the job, its approximate location and preferred dates.
- Professionals in that area and category may ask public questions and submit quotes stating their price, start date and duration.
- The Client accepts whichever quote they prefer. All others are automatically rejected and a messaging channel opens between the two parties.
- Once finished, the Professional marks the job as complete and the Client confirms. From that point both parties may leave a review.
6. Client obligations
- Provide truthful information about the job requested.
- Not to post unlawful, offensive or discriminatory content, or content infringing third-party rights.
- Not to include direct contact details in requests, questions, answers or public reviews.
- To treat Professionals with respect.
- To honour what has been agreed with the Professional whose quote was accepted, including payment of the agreed price.
7. About Professionals and verification
In order to quote, every Professional must expressly declare that they are lawfully registered and that they comply with the regulations applicable to them where the service is provided. That declaration is the Professional's sole responsibility.
In addition, a Professional may voluntarily provide documentation evidencing their registration and their public liability insurance. Where they do, Handnitas checks that those documents exist and are in force, and displays a Verified badge.
The Verified badge means only that the existence and validity of certain documents was checked on a specific date. It is not a recommendation, a certification of technical competence, a guarantee of quality of work or an endorsement of solvency.
8. Reviews
When a job is completed, Client and Professional may review each other. Reviews are not published until both parties have written theirs, or fourteen days have passed since the first, whichever comes first.
Reviews express the opinion of their author, not of Handnitas. We reserve the right to remove reviews containing insults, third-party personal data, unlawful content or manifestly false statements.
9. Limitation of liability
Handnitas is a technology intermediary. To the fullest extent permitted by applicable law, it is not liable for the quality, safety, legality or suitability of the work performed; compliance with timescales, quotes or agreements between the parties; damage of any kind caused during the performance of a job; the accuracy of information published by users; or the consequences of either party's breach.
Nothing in this clause excludes or limits Handnitas' liability where the law does not permit its exclusion, in particular towards consumers.
10. Availability, suspension and closure
Handnitas aims to keep the platform continuously available but does not guarantee uninterrupted operation. It may suspend or cancel accounts that breach these terms. Users may close their account at any time from their profile.
11. Intellectual property
The app, its brand, its design and its content belong to Handnitas. Users retain ownership of the content they post and grant Handnitas a free, non-exclusive licence to display it within the platform.
12. Governing law and jurisdiction
These terms are governed by the law of Gibraltar, and the courts of Gibraltar shall have jurisdiction. If you are acting as a consumer and habitually reside elsewhere, this clause does not deprive you of the protection afforded by the mandatory rules of your place of residence.
Conditions for Professionals
1. No employment relationship
Handnitas is not the Professional's employer, client, contractor or labour intermediary. The Professional acts on their own account, with full organisational, technical and economic autonomy. They freely set their prices, timescales and working methods. There is no exclusivity, working hours, schedule, direction or subordination of any kind.
2. Declaration of compliance
In order to submit quotes, the Professional must expressly declare that:
- They are lawfully registered as a self-employed worker, professional or business.
- They comply with their tax and social security obligations.
- They hold the licences, permits, authorisations or qualifications required.
- Where they provide services in a territory other than that of their establishment, they meet the legal requirements there, including work permits where applicable.
- They hold, or undertake to hold, appropriate public liability insurance.
This declaration is the Professional's sole responsibility. Handnitas does not verify its accuracy of its own motion. A false declaration is a serious breach and entitles Handnitas to cancel the account immediately.
3. Price of the service
Handnitas is currently free for Professionals: no joining fee, no charge to quote, and no commission on jobs awarded.
Handnitas reserves the right to introduce paid plans, fees or commissions in the future, with clear communication and reasonable notice, and with no retrospective effect on jobs already awarded.
4. Quotes
Quotes must be truthful, complete and realistic, with labour and materials broken down, and with a start date and duration the Professional can reasonably meet. The currency is determined by the location of the job and cannot be changed.
5. No circumvention of the platform
The Professional undertakes not to use the platform to obtain contacts in order to operate outside it systematically, nor to provide direct contact details before a job is awarded.
6. Liability
The Professional is solely responsible for the work they carry out, for any damage they may cause, for compliance with their legal obligations and for the accuracy of the information they publish. They shall indemnify Handnitas against any third-party claim arising from their activity.
7. Governing law
Governed by the law of Gibraltar, whose courts shall have jurisdiction over the relationship between the Professional and Handnitas. Matters of taxation, social security and cross-border work permits are the sole responsibility of each Professional.
